MahaRERA rules a draft conveyance deed is not compliance, sets a 60-day deadline

A July 15 order on a Kiwale society's complaint sets a 60-day clock to registration and holds that a draft deed alone is not compliance.

MahaRERA has ordered a developer to complete the conveyance of a housing project to its residents' society, ruling that merely sending across a draft deed does not amount to discharging the statutory obligation. The July 15 order, passed by Member Mahesh Pathak on a complaint by the Nirmaan Milestone Co-operative Housing Society in Kiwale, gives the builder 30 days to finalise the draft and another 30 to register the deed in the society's name.

The society had objected that the developer's draft understated the area being conveyed relative to sanctioned plans and the project's registration records. The authority directed that common areas, access roads and the undivided rights attached to them be transferred as approved, along with all documents the society needs to complete conveyance.

Conveyance is the chronic last mile of Indian housing: societies can occupy a completed building for decades without holding title to the land beneath it. In redevelopment-heavy MMR the gap has real costs — without conveyance, societies cannot mortgage, redevelop on their own terms, or fully capture the value of unused development rights.

Orders like this one, with explicit deadlines and a finding that paper gestures are not compliance, give societies across Maharashtra a sharper precedent to press builders with — and add to MahaRERA's recent enforcement tilt on post-completion obligations.
