Maharashtra's new housing society rules cut redevelopment consent to 51% of members

Maharashtra has overhauled the rulebook governing its co-operative housing societies. The Maharashtra Co-operative Societies (Amendment) Rules, 2026 — notified on June 18, published in the gazette on June 22 and effective June 30 — insert a new Chapter XI-B that consolidates provisions on registration, membership, governance, recovery and, most consequentially, redevelopment.

Two changes stand out. Consent for selecting a redevelopment developer is now pegged at 51 per cent of a society's total membership, replacing the stiffer consent arithmetic that has frequently stalled projects at the resolution stage. And for societies choosing self-redevelopment, borrowing capacity is defined at up to ten times the value of the society's land, based on a government-approved valuer's report. Redevelopment meetings can also now be held over video conference, easing participation for elderly members and NRIs.

The relevance to the MMR is direct. Greater Mumbai and its suburbs hold thousands of ageing societies where redevelopment is the principal route to new supply, and the consent threshold has long been the single most common point of failure. A clean majority standard shifts the negotiating dynamic between societies, holdout members and developers.

The fine print still matters: the rules operate alongside existing directives and a large body of case law, and how registrars and courts read the new chapter will shape outcomes. Societies weighing offers should treat the new thresholds as a starting line, not a shortcut.
