MahaRERA's July orders hold the line on delay interest and shut the review-plea backdoor

Three orders in a fortnight — a rejected review petition, a refund direction and fresh delay interest — signal the regulator's discipline on Section 18.

MahaRERA has rejected a review application by Kumar Properties and Developers LLP that sought to reopen an order directing the developer to pay a homebuyer interest for delayed possession in Pune's 47 East project. In the order dated July 9, chairperson Manoj Saunik held that the plea did not meet the requirements of Rule 36 of the MahaRERA (General) Regulations, 2017 — review is meant for errors apparent on the record, not a second round of argument.

The decision caps a run of buyer-friendly orders this month. The authority directed Esteem Constructions, an Adani group entity, to refund a complainant couple in Pune's Atelier Greens project (excluding statutory taxes and stamp duty) within 60 days, while dismissing two other delay complaints as premature. Separately, United Constructions, developer of the 38 Divine project in Kondhwa, was ordered to pay statutory interest under Section 18 of RERA from January 1, 2026 until possession is handed over with the occupancy certificate — with the developer's missing compliance reports also drawing scrutiny.

Though the cases are from Pune, the reasoning applies statewide, and the exposure is arguably largest in the MMR, where redevelopment and late-running projects are concentrated. For buyers, the message is that delay interest under Section 18 is enforceable and difficult to unwind on review; for developers, that compliance filings and possession timelines now carry a measurable cost of slippage.

Orders remain appealable before the Maharashtra Real Estate Appellate Tribunal, and each turns on its own facts — but the direction of travel from the regulator is consistent.
