Maharashtra caps stamp duty at 0.5 per cent on societies' 99-year lease registrations

A July 8 decision slashes the cost of registering decades-old lease agreements for Mumbai's cooperative housing societies, clearing a quiet blocker to redevelopment.

The Maharashtra government has capped stamp duty on registering lease agreements for land allotted to cooperative housing societies on 99-year leases or occupancy rights at 0.5 per cent for residential properties and 1.5 per cent for commercial ones. Revenue Minister Chandrashekhar Bawankule announced the change on July 8. Until now, the duty could run as high as 5 per cent depending on lease terms and premiums — often adding up to crores for a single society.

The measure addresses a decades-old anomaly. Many societies in Mumbai and its suburbs were allotted government land in the 1960s and 1970s but never registered their lease agreements, as costs and administrative delays kept the paperwork pending. An unregistered lease muddies title, which in turn complicates loans, transfers and — most importantly for a city of ageing buildings — redevelopment approvals.

The scale of the relief can be dramatic. In one reported example, a society at Nariman Point that faced a stamp duty bill of over ₹101 crore under the old computation will now pay about ₹10.68 lakh.

For the MMR market, the direction is clear: cheaper regularisation means cleaner titles, and cleaner titles widen the pool of societies that can credibly enter redevelopment. The move complements the state's broader push on cluster and self-redevelopment. Societies should still verify how the notification applies to their specific lease terms before budgeting.
