Maharashtra gives housing societies their own rulebook, six years after the law changed

Maharashtra has notified the Co-operative Societies (Amendment) Rules, 2026, inserting a dedicated Chapter XI-B into the Maharashtra Co-operative Societies Rules, 1961. The notification, issued by the Co-operation, Marketing and Textiles Department on June 18, is only now being unpacked by society managers and practitioners, and the coverage this week explains why: it is the first standalone statutory rulebook for the state's roughly 1.25 lakh co-operative housing societies.

The gap it closes is an old one. A 2019 amendment to the parent Act created a separate chapter for housing societies, but the corresponding rules were never framed, leaving registrars, managing committees and members to lean on model bye-laws of uncertain legal force. The new rules, numbered 106C-1 to 106C-14, cover registration, membership including associate and provisional members, nominations, governance, borrowing limits, funds and levies, and recovery proceedings.

The redevelopment provisions carry the most weight for the Mumbai region, where ageing societies signing developer agreements have become the city's main supply pipeline. Consent thresholds, meeting procedures and the sequence of approvals now rest on statutory rules rather than advisory bye-laws, which should narrow the room for the disputes that routinely stall projects.

The transition will not be frictionless: committees must reconcile existing bye-laws with the new chapter, and awareness across more than a lakh societies will take time. But for buyers evaluating redevelopment projects, a clearer legal spine for the society side of the transaction is a quiet positive.
